Privacy Policy

Draft. This document is not final and does not bind anyone yet. It is awaiting an attorney's review and the details still shown in [brackets].

Effective date: [DATE]. This policy explains what Phuglee Data LLC ("Phuglee") collects about Members and visitors, how we use it, and the choices available. It also explains, in the final section, how we handle information about property owners that appears in the Data we sell.

Information we collect from Members and visitors

Account information you give us: name, email, phone, company, password (stored hashed), and the counties or cities you choose.
Payment information is collected and stored by Stripe, our payment processor. We receive the last four digits of your card, its brand and expiry, and your billing address and transaction history. We never receive or store your full card number.
Application information for Statewide packages: team size, deal history, budget and how you plan to work leads.
Usage information: pages visited, records viewed and exported, downloads, IP address, browser and device type, and the times you sign in. We use a session cookie to keep you signed in and basic analytics cookies. We do not use advertising cookies.
Communications: emails, texts and support requests you send us, and our replies.

How we use it

To provide the Service: create your account, hold your seat, deliver Data, send alerts you turn on, and bill you.
To enforce the Terms, including the seat caps, download allowances and the no-resale license, and to detect fraud and abuse.
To communicate with you about your account, renewals, changes to the Service and, if you opt in, product news. You can turn off marketing email at any time; account and billing notices continue while you are a Member.
To improve the Service using aggregated, de-identified usage data.

Who we share it with

We do not sell Member personal information. We share it only with service providers who need it to run the Service under contract: Stripe (payments), Google Workspace (email, including support mail), Twilio (text alerts) and Railway (hosting). We also disclose information when the law requires it, to protect our rights or safety, or in connection with a sale or merger of our business, in which case this policy continues to apply.

Retention and security

We keep account information while your account is active and for up to 7 years afterward for tax, accounting and dispute purposes. Usage logs are kept for 24 months. We protect information with encrypted connections, hashed passwords, access controls and hosting in a U.S. data center. No system is perfectly secure; tell us at support@phuglee.com if you believe your account has been compromised.

Your rights

Depending on your state, you may have the right to know what personal information we hold about you, to correct it, to delete it, to receive a copy, and to opt out of sales or targeted advertising (we do neither for Members). To exercise any right, email support@phuglee.com from the address on your account. We will respond within 45 days and will not treat you differently for making a request. We do not knowingly collect information from anyone under 18.

Information about property owners in our Data

The Data we license to Members contains information about real property and, where the public record includes it, the names of owners, estate representatives, tenants and other parties named in court and government filings. We obtain this information exclusively from public records: county court dockets, recorder and clerk offices, city code enforcement departments and fire departments. We do not obtain it from the individuals themselves, from credit bureaus or from private databases.

We license this information only for real estate acquisition and marketing use under the restrictions in our Terms of Service, which forbid resale and forbid any use covered by the Fair Credit Reporting Act.

If you are a property owner and want out. Email privacy@phuglee.com with your name and the property address. We will remove your record from future deliveries to Members within 30 days and instruct Members who received it to honor the request, though we cannot recall copies already exported. Requests under state privacy laws are handled the same way.
